- The owner knew or should have known — Did they create the hazard? Had it existed long enough that they should have discovered it?
- The condition caused your injury — Direct causation between the hazard and your harm.
- You suffered damages — Medical bills, lost wages, pain and suffering.
The "Knew or Should Have Known" Standard
Florida courts require you to prove the business or property owner had actual or constructive knowledge of the hazard. This is often the most contested element. Evidence like:
- Surveillance footage
- Incident reports
- Employee testimony
- Prior complaints about the same condition
...can be decisive.
Act Quickly — Evidence Disappears Fast
Surveillance footage is often overwritten within 30–72 hours. Spills get cleaned up. Witnesses forget. The moment you're able, take photos, report the incident in writing, and contact an attorney.
Modified Comparative Negligence in Florida
As of 2023, Florida shifted to a modified comparative negligence standard. If you are found more than 50% at fault for your own injury, you cannot recover damages. Insurance companies will aggressively argue you were responsible — having strong legal representation is essential.
